Rental Conditions

These Rental Conditions govern the rental of motorcycles, trailers, and rider equipment from AdventureCZ (operated by Orot technologies s.r.o.), and AdventureCZ’s optional delivery of that equipment to and from a venue. They apply from the point a booking is confirmed, alongside the separate Terms of Use for the website itself.
1. What AdventureCZ provides — and what it doesn’t
AdventureCZ’s own service is the rental of motorcycles, trailers, and rider equipment, and delivery of that equipment to and from a venue on request. Coached training days and guided tours advertised on this site are organized and run by independent partner organizations (see the Partners section) — you book and pay for those activities directly with the partner, not with AdventureCZ. AdventureCZ’s role regarding those activities is limited to zprostředkování (intermediation, under §2445 et seq. of the Civil Code): connecting you with the partner. AdventureCZ is not a party to the training/touring contract and doesn’t accept payment for it, and these Rental Conditions don’t govern that activity or its risk/liability terms, which are the partner’s responsibility under your separate agreement with them. If you rent equipment from AdventureCZ to use during a partner-run activity, this document governs only your rental of that equipment.
2. Eligibility
- You must hold a valid motorcycle licence of at least category A2 (or A, as applicable to the specific bike) recognised in the Czech Republic.
- You must be in adequate physical health to operate the vehicle. Please tell us about any condition that could affect your ability to ride safely.
- Minimum age requirements follow the licence category above.
3. Booking, deposit, and no-show fee
- A security deposit of 10,000 CZK (≈ €400) is payable before the motorcycle is handed over, and is returned after the rental once any deductions under §4 are settled.
- For online/remote bookings, a non-refundable deposit of 2,000 CZK (≈ €80) — equivalent to one day’s rental — is payable at booking and forfeited if you don’t show up. Under Czech law (§1808–1809 of Act No. 89/2012 Sb., the Civil Code), this is structured as a závdavek (earnest money): if you withdraw or fail to appear, we keep it; if we fail to provide the vehicle as booked, we owe you back double. This term is restated in the individual rental agreement signed at booking/pickup, as required by law for it to bind you.
- We reserve the right to decline or cancel a booking (e.g. for unsafe weather, terrain conditions, or if eligibility requirements aren’t met), in which case any deposit paid is refunded in full.
4. Equipment condition, damage, and insurance
- The motorcycle, trailer, and any rented equipment are handed over in good working condition, inspected before handover; report any concern before use.
- You’re responsible for the equipment for the duration of the rental, and for returning it in the condition it was provided, normal wear excepted.
- AdventureCZ’s motorcycles are insured. Any damage to the motorcycle, trailer, or equipment during the rental is deducted from the security deposit up to its full amount; any remaining deposit balance is refunded once the damage is assessed and the cost of repair is confirmed. Damage beyond the deposit amount is your responsibility to cover directly.
- Report any accident or damage immediately, including to the police where a traffic accident is involved, and provide photos of the scene.
5. Permitted use and where you’re allowed to ride
The vehicle is for use on public roads and on off-road terrain where that use is actually legal — it’s your responsibility to know the difference, not just AdventureCZ’s. Under Czech law, driving a motor vehicle off-road is restricted or prohibited in several common situations, including:
- Open countryside and agricultural land outside roads and purpose-built communications, without the landowner’s consent (Act No. 114/1992 Sb., §63)
- Forests, where driving and parking motor vehicles is generally prohibited (Act No. 289/1995 Sb., the Forestry Act, §20(1)) — fines of up to 100,000 CZK apply for serious violations
- National parks, protected landscape areas (CHKO), and nature reserves, where off-road vehicle entry is generally prohibited without the nature conservation authority’s consent (Act No. 114/1992 Sb., §§24, 29)
Racing, competition use, closed-circuit riding, and use of the vehicle for paid transport of people or goods are not permitted under this rental regardless of terrain.
6. Assumption of risk
Operating an off-road motorcycle involves inherent risks, including but not limited to falls, collisions, uneven or unpredictable terrain, weather, and mechanical failure, which can result in serious injury or death. By renting, you acknowledge and voluntarily accept these risks.
7. Rider conduct
- No riding under the influence of alcohol or drugs.
- Follow all applicable traffic and terrain-access rules, including those in §5.
- We may end the rental without refund if these rules are seriously or repeatedly broken.
8. Limitation of liability
To the fullest extent permitted by Czech law, AdventureCZ’s liability for loss or damage arising from the rental is limited as set out in this document. Under §2898 of the Civil Code, an advance agreement excluding or limiting liability for harm to a person’s health or life is disregarded regardless of its wording — this document doesn’t attempt to waive that liability. A physical or digital acknowledgement of the risks in §6 is signed at pickup before the rental begins.
9. Governing law
These Rental Conditions are governed by the laws of the Czech Republic. Nothing here limits any mandatory consumer-protection rights you have under the law of your country of residence.
